Pe l\u00e2ng\u0103 faptul c\u0103 este inclus\u0103 \u00een <a href=\"https:\/\/luiza.manolea.ro\/blog\/2011\/05\/30\/energie-din-surse-regenerabile-in-constructii\/\">pachetul legislativ \u201e20-20-20\u201d<\/a><a href=\"#_ftn1\"><\/a>, reprezent\u00e2nd una din cele trei \u0163inte de atins (reducerea cu 20% a folosirii energiei primare fa\u0163\u0103 de consumul previzionat \u00een 2020 prin \u00eembun\u0103t\u0103\u0163irea eficien\u0163ei energetice), constituie \u015fi prioritatea num\u0103rul unu \u00een <a href=\"http:\/\/eur-lex.europa.eu\/LexUriServ\/LexUriServ.do?uri=CELEX:52010DC0639:EN:HTML:NOT\">Strategia european\u0103 pentru energie competitiv\u0103, durabil\u0103 \u015fi sigur\u0103<\/a><a href=\"#_ftn2\"><\/a> pentru anii 2011-2020.<\/p>\n<p>De aici \u015fi aten\u0163ia dat\u0103 unei propuneri efectuat\u0103 de Comisia European\u0103 la 22 iunie 2011 de a adopta o <strong><a href=\"http:\/\/eur-lex.europa.eu\/LexUriServ\/LexUriServ.do?uri=COM:2011:0370:FIN:RO:PDF\">nou\u0103 Directiv\u0103 privind eficien\u0163a energetic\u0103<\/a><a href=\"#_ftn3\"><strong> <\/strong><\/a><\/strong>, ceea ce va presupune abrogarea <a href=\"http:\/\/eur-lex.europa.eu\/LexUriServ\/LexUriServ.do?uri=DD:12:02:32006L0032:RO:PDF\">Directivei 2006\/32\/CE privind eficien\u0163a energetic\u0103 la utilizatorii finali \u015fi serviciile energetice [1]<\/a> \u015fi a Directivei 2004\/8\/CE privind promovarea cogener\u0103rii pe baza cererii de energie termic\u0103 util\u0103 pe pia\u0163a intern\u0103 a energiei<a href=\"#_ftn5\">[2]<\/a>. Mai multe informatii despre cogenerare <a href=\"https:\/\/luiza.manolea.ro\/blog\/2011\/07\/19\/beneficiile-cogenerarii\/\">gasiti aici<\/a>.<\/p>\n<p>Faptul declan\u015fator a fost concluzia la care a ajuns Comisia European\u0103 dup\u0103 analiza slabelor progrese ale statelor membre \u00een domeniul eficien\u0163ei energetice \u00een sensul c\u0103 trebuie luate m\u0103suri mult mai stricte, c\u0103ci cele luate \u00een baza legisla\u0163iei prezente, care are mai mult un caracter indicativ dec\u00e2t obligatoriu, nu conduc dec\u00e2t la realizarea unor economii de 10% din cele 20% dorite pentru anul 2020. Progresele ce vor fi realizate vor fi analizate \u00een 2014 \u015fi, \u00een cazul \u00een care se va dovedi c\u0103 nu sunt suficiente pentru atingerea obiectivului de reducere a consumului de energie cu 20% p\u00e2n\u0103 \u00een 2020, \u00een locul obiectivelor neobligatorii din prezent vor fi propuse obiective obligatorii la nivel na\u0163ional, ce vor trebui incluse \u00een legisla\u0163ia statelor membre \u00een cel mult un an.<\/p>\n<p>Semnalul astfel dat este acela c\u0103 trebuie s\u0103 consum\u0103m mai pu\u0163in\u0103 energie pentru ceea ce producem, s\u0103 facem economii de energie.<\/p>\n<p>Desigur, mul\u0163i dintre noi sar deja cu g\u00e2ndul la economiile extreme de energie de dinainte de 1989, prin simpla \u00eentrerupere a furniz\u0103rii curentului electric \u2013 surs\u0103 mai degrab\u0103 de inspira\u0163ie pentru umori\u015fti, dac\u0103 ne-aducem aminte de caricatura lui <a href=\"http:\/\/www.google.com\/imgres?q=mihai+stanescu&amp;hl=en&amp;client=firefox-a&amp;hs=Jtg&amp;sa=X&amp;rls=org.mozilla:en-US:official&amp;channel=np&amp;biw=1272&amp;bih=638&amp;tbm=isch&amp;prmd=ivnso&amp;tbnid=nY2FYOxlKY7cBM:&amp;imgrefurl=http:\/\/www.avantaje.ro\/Timp-liber\/Vedete\/Mihai-Stanescu-vanzatorul-de-idei-875328&amp;docid=p95i8uTfKIkIeM&amp;w=275&amp;h=297&amp;ei=HQxqTquBNMiH4gTa8I3tBA&amp;zoom=1\">Mihai St\u0103nescu<\/a> \u00een care este pe un st\u00e2lp de \u00eenalt\u0103 tensiune era o plac\u0103 de avertizare pe care scria (aproximativ): \u201e<em>Pericol de electrocutare! \u00centre orele: 10-12<\/em>\u201d&#8230;<\/p>\n<p>\u00cens\u0103, noua legisla\u0163ie e departe de ideea de a consuma mai pu\u0163in \u015fi de a reduce inevitabil dezvoltarea economic\u0103. Dimpotriv\u0103, dore\u015fte s\u0103 ia \u00een calcul acele m\u0103suri care pot fi luate astfel \u00eenc\u00e2t s\u0103 \u00eempace at\u00e2t consumul redus de energie, c\u00e2t \u015fi cre\u015fterea economic\u0103. Iar evitarea risipei de energie printr-o eficien\u0163\u0103 crescut\u0103 a consumului de energie, adic\u0103 ce \u00een\u0163elegem prin eficien\u0163\u0103 energetic\u0103, \u00a0pare exact compromisul c\u0103utat.<\/p>\n<p>\u00cen p\u0103strarea balan\u0163ei \u00eentre reducerea consumului \u015fi dezvoltarea economic\u0103, propunerea de directiv\u0103 amintit\u0103 acord\u0103 un rol important societ\u0103\u0163ilor specializate \u00een prestarea de servicii energetice, care urm\u0103resc performan\u0163a energetic\u0103, adic\u0103 ceea ce \u00eent\u00e2lnim \u00een mod obi\u015fnuit sub acronimul de ESCO (Energy Service Companies).<\/p>\n<p><span style=\"text-decoration: underline;\">Ce sunt ESCO?<\/span><\/p>\n<p>Dac\u0103 e s\u0103 ne lu\u0103m dup\u0103 felul \u00een care sunt definite, am avea de-a face cu mai multe companii care urm\u0103resc \u00eentr-un fel sau altul eficien\u0163a energetic\u0103, \u00eens\u0103 prin diverse tipuri de contracte:<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 contract pentru furnizarea de energie (\u201eEnergy Supply Contracting \u2013 ESC\u201d), care se concentreaz\u0103 pe partea de furnizare a c\u0103ldurii, electricit\u0103\u0163ii, aburilor ori a altor forme de folosire a energiei \u00eentr-o manier\u0103 eficient\u0103;<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 contract pentru performan\u0163\u0103 energetic\u0103 (\u201eEnergy Performance Contracting \u2013 EPC\u201d), care difer\u0103 de contractul de furnizare de energie &#8211; ESC prin faptul c\u0103 se orienteaz\u0103 pe partea de nevoie de investi\u0163ii pentru \u00eembun\u0103t\u0103\u0163irea eficien\u0163ei energetice a cl\u0103dirii \u015fi nu se rezum\u0103 doar la partea de furnizare de energie. De asemenea, o alt\u0103 diferen\u0163\u0103 fa\u0163\u0103 de ESC este c\u0103 prestatorul \u00ee\u015fi asum\u0103 riscul execut\u0103rii proiectului, \u00een sensul c\u0103 leag\u0103 recuperarea investi\u0163iei de garantarea unor anumite reduceri de consum a energiei.<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 contracte pentru cump\u0103rarea de electricitate (\u201ePower Purchase Agreements \u2013 PPAs\u201d) sau de prestare de servicii energetice (\u201eESAs\u201d), care se \u00eent\u00e2lnesc \u00een mod obi\u015fnuit \u00een cazul centralelor de co- sau trigenerare descentralizate, de cartier ori care folosesc energie din surse regenerabile, produs\u0103 local. \u00cen baza unor astfel de tipuri de contracte, proprietarul cl\u0103dirii convine s\u0103 cumpere toat\u0103 c\u0103ldura, r\u0103cirea \u015fi\/sau energia electric\u0103 produs\u0103 de compania prestatoare ESCO sau de un ter\u0163 care de\u0163ine echipamentele, precum \u015fi \u00eembun\u0103t\u0103\u0163irile aduse cl\u0103dirii la un pre\u0163 fix sau indexat potrivit contractului pe unitatea de energie (termic\u0103, electric\u0103) furnizat\u0103.<\/p>\n<p>Serviciile de performan\u0163\u0103 energetic\u0103 &#8211; EPC se aseam\u0103n\u0103 cu celelalte prin anumite elemente comune, \u00eens\u0103 presupun \u015fi c\u00e2teva elemente specifice. Astfel, serviciile se aseam\u0103n\u0103 prin faptul c\u0103:<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00eembun\u0103t\u0103\u0163esc eficien\u0163a energetic\u0103 a unei cl\u0103diri,<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 reduc costurile cu utilizarea cl\u0103dirii,<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 investi\u0163iile sunt recuperate \u00een timp prin economiile la cheltuieli,<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 op\u0163ional, pune \u00een practic\u0103 o schem\u0103 de finan\u0163are care elimin\u0103 necesitatea unor investi\u0163ii ini\u0163iale efectuate de proprietarul cl\u0103dirii.<\/p>\n<p>Specificitatea serviciilor de performan\u0163\u0103 energetic\u0103 \u2013 EPC const\u0103 \u00een faptul c\u0103 o asftel de companie:<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 furnizeaz\u0103 un serviciu complet, \u201ela cheie\u201d, ceea ce \u00eenseamn\u0103 c\u0103 acoper\u0103 toate aspectele unui proiect, de la un audit ini\u0163ial p\u00e2n\u0103 la instalarea echipamentelor \u015fi monitorizarea economiilor;<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 efectueaz\u0103 m\u0103sur\u0103tori \u015fi verific\u0103ri riguroase ale economiilor realizate, de obicei \u00een baza unor metodologii consacrate prin protocoale interna\u0163ionale;<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00ee\u015fi asum\u0103 riscul de executare a proiectului pe toat\u0103 durata realiz\u0103rii construc\u0163iilor \u015fi pe perioada c\u00e2t timp garanteaz\u0103 efectuarea de economii. Adic\u0103, ESCO \u00ee\u015fi ia asupra ei riscul s\u0103 respecte un anumit nivel al reducerii costurilor, ce provine din reducerea consumurilor pe care cl\u0103direa le are cu energia, apa, munca de \u00eentre\u0163inere etc. \u00cen practic\u0103, o ESCO \u015fi un proprietar al unei cl\u0103diri \u00ee\u015fi \u00eempart aceste riscuri fie prin \u00eemp\u0103r\u0163irea prin contract a beneficiilor rezultate din economiile cu reducerea consumurilor, fie prin acordarea de c\u0103tre ESCO a garan\u0163iei c\u0103 \u00eembun\u0103t\u0103\u0163irile aduse vor conduce la un anume procentaj al economiei de energie pe durata contractului; \u00een caz contrar, ESCO se oblig\u0103 fa\u0163\u0103 de proprietar s\u0103 pl\u0103teasc\u0103 pentru orice derapaj fa\u0163\u0103 de nivelul de economii-etalon stabilit prin contract.<\/p>\n<p><span style=\"text-decoration: underline;\">Oportunit\u0103\u0163ile aduse de noua Directiv\u0103 &#8211; eliminarea unor bariere<\/span><\/p>\n<p>Spre deosebire de Directiva 2006\/32\/CE \u00een vigoare \u00een prezent, noua Directiv\u0103 propus\u0103 la 22 iunie 2011 acord\u0103 un loc mult mai important societ\u0103\u0163ilor de servicii energetice. Astfel, dac\u0103 textul \u00een prezent instituie statelor membre o obliga\u0163ie at\u00e2t de vag\u0103, \u00eenc\u00e2t are mai mult o valoare de recomandare, potrivit noii Directive, statele membre au o obliga\u0163ie clar\u0103 cu privire la promovarea pie\u0163ei serviciilor energetice, precum \u015fi cu privire la eliminarea barierelor din calea acestor servicii.<\/p>\n<p>Este de remarcat c\u0103 noua Directiv\u0103 aduce solu\u0163ii unor obstacole care \u00eempiedicau dezvoltarea pie\u0163ei de servicii energetice, r\u0103spunz\u00e2nd astfel \u015fi unor probleme identificate \u00een Raportul Rom\u00e2niei<a href=\"#_ftn6\">[3]<\/a> despre condi\u0163iile-cadru politice, economice, legale \u015fi financiare ale contractelor de performan\u0163\u0103 energetic\u0103, elaborat de ANRE \u00een noiembrie 2009.<\/p>\n<p>\u00cen acest sens:<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 lipsa de informare despre ESCO se dore\u015fte reparat\u0103 prin obligarea statelor membre: (i) de a crea, actualiza \u015fi publica o list\u0103 cu furnizorii de servicii energetice \u015fi cu serviciile pe care ace\u015ftia le ofer\u0103, (ii) de a disemina informa\u0163ii despre instrumentele financiare, stimulentele, \u00eemprumuturile nerambursabile \u015fi creditele pentru sprijinirea proiectelor privind serviciile energetice;<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 dificult\u0103\u0163ile prin prisma licita\u0163iilor \u00eent\u00e2mpinate de autorit\u0103\u0163ile publice la achizi\u0163ionarea serviciilor energetice se doresc \u00eendep\u0103rtate prin oferirea de modele de contracte privind performan\u0163a energetic\u0103 adresate sectorului public;<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 imposibilitatea financiar\u0103 \u015fi contabil\u0103 mai ales a autorit\u0103\u0163ilor locale (ex.: prim\u0103rii) de a pl\u0103ti o ESCO din economiile \u00eenregistrate cu consumul de energie \u00ee\u015fi va g\u0103si o solu\u0163ie prin obligarea statelor membre de a adopta dispozi\u0163ii legale \u015fi administrative privind achizi\u0163iile publice, \u00eentocmirea bugetului anual \u015fi contabilitatea.<\/p>\n<p>P\u00e2n\u0103 cel t\u00e2rziu \u00een data de 30 aprilie 2014 Rom\u00e2nia va trebui s\u0103 trimit\u0103 un raport care s\u0103 cuprind\u0103 evaluarea barierelor legale, administrative \u015fi de alt\u0103 natur\u0103, precum \u015fi m\u0103surile luate pentru eliminarea lor.<\/p>\n<p><span style=\"text-decoration: underline;\">Concluzie: noua legisla\u0163ie aduce ve\u015fti bune dezvoltatorilor ESCO<\/span><\/p>\n<p>Prin urmare, at\u00e2t cei care au derulat cu succes proiecte \u00een domeniul eficientiz\u0103rii energetice a cl\u0103dirilor<a href=\"#_ftn7\">[4]<\/a>, c\u00e2t \u015fi cei care doresc s\u0103 se orienteze c\u0103tre aceast\u0103 pia\u0163\u0103 au toate \u015fansele s\u0103 beneficieze de o legisla\u0163ie mult mai prietenoas\u0103 dec\u00e2t cea aplicabil\u0103 \u00een prezent.<\/p>\n<p style=\"text-align: left;\">* * *<\/p>\n<div style=\"text-align: left;\">\n<hr size=\"1\" \/>\n<p><a href=\"#_ftnref4\">[1]<\/a> Directiva 2006\/32\/CE a fost transpus\u0103 \u00een legisla\u0163ia rom\u00e2neasc\u0103 prin Ordonan\u0163a de urgen\u0163\u0103 nr. 22\/2008.<\/p>\n<div>\n<p><a href=\"#_ftnref5\">[2]<\/a> Directiva 2004\/8\/CE a fost transpus\u0103 \u00een legisla\u0163ia rom\u00e2neasc\u0103 prin Hot\u0103r\u00e2rea de Guvern nr. 219\/2007 privind promovarea cogener\u0103rii bazate pe cererea de energie termic\u0103 util\u0103.<\/p>\n<\/div>\n<div>\n<p><a href=\"#_ftnref6\">[3]<\/a> Raportul de \u0163ar\u0103 (\u00een limba englez\u0103) a fost elaborat de ANRE \u00een noiembrie 2009 \u00een cadrul proiectului \u201eEuropean Energy Service Initiative\u201d \u015fi <a href=\"http:\/\/www.european-energy-service-initiative.net\/fileadmin\/user_upload\/bea\/Documents\/Country_Reports_EESI\/CountryReport_EESI_WP2_Romania_1.pdf\">se g\u0103se\u015fte aici<\/a>.<\/p>\n<\/div>\n<div>\n<p><a href=\"#_ftnref7\">[4]<\/a> Vezi \u015fi <a href=\"http:\/\/www.european-energy-service-initiative.net\/eu\/good-practice-examples\/more-examples\/more-examples-from-romania.html\">http:\/\/www.european-energy-service-initiative.net\/eu\/good-practice-examples\/more-examples\/more-examples-from-romania.html<\/a><\/p>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Eficien\u0163a energetic\u0103 ocup\u0103 un rol important \u00een legisla\u0163ia european\u0103.
